Refund policy
RETURN & REFUND POLICY
At The Cape Brake Co., we want our customers to order the correct products for their vehicles and to understand our returns process before purchasing.
Due to the nature of automotive parts, accessories and vehicle-specific products, returned goods must meet the conditions set out below.
Nothing in this policy is intended to limit or exclude any rights available to a consumer under the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), or any other applicable South African law.
1. CHANGE-OF-MIND RETURNS
Subject to any rights available under applicable South African law, The Cape Brake Co. accepts eligible change-of-mind returns within 14 days of delivery or collection, provided that:
- The product is unused and has not been fitted, installed or attempted to be fitted.
- The product packaging is completely unopened, undamaged and in its original condition.
- All seals, labels, protective coverings, accessories, manuals and components remain intact.
- The product is in the same condition in which it was supplied and is suitable for resale as new.
- Valid proof of purchase from The Cape Brake Co. is provided.
For an ordinary change-of-mind return, the customer is responsible for the cost and risk of returning the product to The Cape Brake Co., except where applicable law provides otherwise.
2. OPENED OR DAMAGED PACKAGING
The Cape Brake Co. does not accept ordinary change-of-mind returns once product packaging has been opened, unsealed, torn, cut, damaged or otherwise compromised.
Automotive products are frequently vehicle-specific, and once packaging has been opened we may no longer be able to verify the condition of the product or resell it as new.
Customers are therefore strongly encouraged to confirm that they have received the correct product and that it is suitable for their vehicle before opening the packaging.
This restriction does not affect any statutory rights that may apply to defective, unsafe, incorrectly supplied or otherwise non-compliant goods.
3. FITTED, INSTALLED OR USED PRODUCTS
The Cape Brake Co. does not accept ordinary change-of-mind returns for products that have been fitted, installed, partially installed, attempted to be fitted, used, modified, altered, programmed, wired, painted, drilled, cut or otherwise changed from the condition in which they were supplied.
Customers must confirm product compatibility before opening packaging or attempting installation.
Where a product has been fitted or installed and is subsequently alleged to be defective, the matter will be treated as a warranty or statutory defect claim rather than an ordinary return.
The product may therefore need to undergo inspection, testing and/or the applicable manufacturer, distributor, supplier or vendor warranty assessment process.
4. VEHICLE FITMENT & COMPATIBILITY
Many products sold by The Cape Brake Co. are vehicle-specific.
Compatibility may depend on information including, but not limited to:
- Make
- Model
- Model year
- Vehicle generation or model code
- Engine and engine code
- Body configuration
- Drivetrain
- Transmission
- Production date
- Vehicle specification or variant
- VIN or chassis information
Vehicle registration year alone may not always establish compatibility, as model generations, production dates and specifications can overlap.
Where there is any uncertainty regarding compatibility, customers should contact The Cape Brake Co. before placing an order or opening the product packaging.
Where The Cape Brake Co. recommends a product based on information supplied by the customer, the accuracy of that recommendation depends on the customer providing complete and accurate vehicle information.
Where The Cape Brake Co. supplies or recommends an incorrect product despite having been provided with complete and accurate vehicle information, please contact us so that the matter can be resolved.
5. INCORRECTLY SUPPLIED PRODUCTS
If you receive a product different from the product you ordered, please contact The Cape Brake Co. as soon as reasonably possible.
Where The Cape Brake Co. has supplied the incorrect product, we will arrange the appropriate return and replacement or refund, as applicable, at our cost.
Where a product can reasonably be identified as incorrect before installation, customers should not open, fit, modify or install the product.
6. DEFECTIVE GOODS & WARRANTY CLAIMS
The Cape Brake Co. is a retailer and reseller of products supplied by a range of manufacturers, importers, distributors, suppliers and vendors.
Where a product is believed to be defective, please contact us as soon as reasonably possible with details of the problem.
A suspected defective product may need to undergo a warranty assessment in accordance with the applicable manufacturer's, importer's, distributor's, supplier's or vendor's warranty procedure.
This assessment may require:
- Inspection or testing of the product
- Photographs or video of the reported fault
- Proof of purchase
- Vehicle details
- VIN or chassis information
- Installation or fitment information
- Diagnostic information where relevant
- Details of the circumstances in which the fault occurred
- Return of the product for physical assessment
Customers must not continue to use a product where doing so may cause additional damage or create a safety risk.
Where reasonably required, the product may need to be returned to The Cape Brake Co. or submitted to the relevant supplier, distributor, importer or manufacturer for assessment.
A warranty claim may be declined where the reported failure is found to have resulted from circumstances including, where applicable:
- Incorrect installation or fitment
- Installation on an incompatible vehicle
- Misuse, abuse or neglect
- Accident, impact or external damage
- Unauthorised modification or alteration
- Improper wiring or electrical installation
- Failure to follow manufacturer installation, maintenance or operating instructions
- Normal wear and tear
- Damage caused after the product left the control of The Cape Brake Co. that is unrelated to an inherent product defect
Where a claim is made under an additional manufacturer, supplier, distributor, importer or vendor warranty, the assessment, remedy and claims procedure may be subject to the terms and conditions of that warranty.
Nothing in this warranty assessment process limits or replaces any statutory rights available to the customer under the Consumer Protection Act or other applicable South African law.
Where the statutory implied warranty under the CPA applies, qualifying defective goods may be subject to the remedies provided by the CPA.
These statutory rights are separate from The Cape Brake Co.'s voluntary 14-day change-of-mind return policy and are not dependent on the packaging remaining unopened.
7. MANUFACTURER, SUPPLIER, DISTRIBUTOR & VENDOR WARRANTIES
Many products sold by The Cape Brake Co. carry additional warranties provided by their manufacturer, importer, distributor, supplier or vendor.
The duration, scope, exclusions and conditions of these warranties vary between brands and products.
Where applicable, The Cape Brake Co. will assist customers in facilitating legitimate warranty claims with the relevant manufacturer, importer, distributor, supplier or vendor.
Customers may be required to provide information or documentation reasonably required for the warranty assessment.
Products may also need to be made available for inspection or testing before a claim under an additional warranty can be determined.
The outcome of a claim made specifically under an additional manufacturer, supplier, distributor, importer or vendor warranty will be determined in accordance with the applicable warranty terms and conditions.
Any such additional warranty operates alongside applicable statutory consumer rights and does not replace or restrict rights provided by South African law.
8. SPECIAL-ORDER & CUSTOM PRODUCTS
Products specially ordered, manufactured, sourced, configured or modified specifically for a customer's requirements may not be eligible for an ordinary change-of-mind return where permitted by applicable law.
Customers will be advised where a product is considered a special-order or custom product where reasonably practicable.
This does not exclude any statutory rights relating to defective, unsafe, incorrectly supplied or otherwise non-compliant goods.
9. RETURN PROCESS
Before returning any product, please contact The Cape Brake Co. so that we can confirm the appropriate return or warranty process.
Please provide, where applicable:
- Your full name
- Order number or proof of purchase
- Details of the product
- The reason for the return or claim
- Photographs or video where relevant
- Vehicle make, model, year and variant
- VIN or chassis information where required
- Details regarding installation or fitment where relevant

Please do not send goods back without first contacting us, as warranty claims and ordinary returns may require different processes or destinations.
10. RETURN COURIER COSTS
For an eligible ordinary change-of-mind return, the customer is responsible for the direct cost and risk of returning the goods to The Cape Brake Co.
Where goods have been incorrectly supplied by The Cape Brake Co., or where applicable South African law requires the return to be at the supplier's risk and expense, The Cape Brake Co. will bear the applicable return cost.
11. REFUNDS
Returned products will be inspected before an ordinary return is approved.
Where an ordinary change-of-mind return does not satisfy the conditions of this policy, including where packaging has been opened or damaged, the return may be declined, subject always to applicable statutory rights.
Where a refund is approved, the customer will be notified and the refund will be processed using an appropriate payment method.
Original delivery charges may not be refundable for an ordinary change-of-mind return except where required by applicable law.
Nothing in this section limits any refund or remedy to which a consumer is entitled under applicable South African consumer legislation.
12. ONLINE TRANSACTIONS & STATUTORY RIGHTS
Purchases made through our online store may be subject to additional rights under the Electronic Communications and Transactions Act 25 of 2002 (ECTA).
Where statutory cooling-off or cancellation rights under ECTA apply to a transaction, those rights will apply notwithstanding the ordinary change-of-mind conditions contained in this policy.
Nothing in this policy is intended to exclude any consumer right that cannot lawfully be excluded.
13. CONTACT US BEFORE OPENING
Because many automotive parts and 4x4 accessories are vehicle-specific, we strongly recommend contacting us if you have any doubt about fitment or compatibility before opening the packaging.
We would much rather help you confirm the correct part before installation than have you discover that the product is unsuitable after it has been opened or fitted.
